Board of Zoning Appeals

The Board of Zoning Appeals is a citizen board, staffed by the Planning and Development Department, that reviews Conditional Use Permits, Variances, and Appeals related to the Zoning Code.

A Conditional Use Permit is a special permit sometimes required to allow for a specific use within a zoning district or other circumstance as set forth by the City of Fairmont Zoning Code. Conditional Use Permits are often required for uses that could potentially be detrimental to the public health, safety, and general welfare that warrant special consideration before approving.

A Variance is an exemption to the rules and regulations only in particular situations as specified in the Zoning Ordinance and within the limitations of federal, state, and city law.

An Appeal is a consideration to reverse, affirm or modify the order, requirement, decision, or determination of the Planner or other zoning administrative staff member.
